Right of withdrawal

Right of withdrawal: consumers have a right of withdrawal under Art. 52 et seq. of the Italian Consumer Code (Codice del Consumo, Legislative Decree 206/2005). You have the right to withdraw from this contract within fourteen days without giving any reason. The period begins on the day on which you, or a third party other than the carrier indicated by you, takes physical possession of the goods. To exercise your right of withdrawal you must inform us – Lisa Metzdorff, Karthaus 98, I-39020 Schnals (BZ), email: l.metzdorff@schnalsersaege.com – by means of a clear statement (e.g. a letter or an email) of your decision. You may use the attached model withdrawal form for this purpose, although it is not obligatory. To meet the deadline it is sufficient for you to send your communication before the period expires.

Effects of withdrawal: we will reimburse all payments received from you, including the costs of delivery (with the exception of any supplementary costs resulting from your choice of a type of delivery other than the least expensive standard delivery), without undue delay and no later than fourteen days from the day on which we receive your notice of withdrawal. We will use the same means of payment that you used for the initial transaction unless otherwise agreed; you will not incur any fees as a result. We may withhold reimbursement until we have received the goods back, or until you have supplied evidence of having sent them back, whichever is the earlier.

Returns: you must send the goods back to us without undue delay and no later than fourteen days from the day on which you communicate your withdrawal. The deadline is met if you dispatch the goods before that period expires. You will bear the direct cost of returning the goods. You are liable for any diminished value of the goods only where this results from handling other than what is necessary to establish their nature, characteristics and functioning.

Exclusion of the right of withdrawal: the right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and are made on the basis of an individual choice or decision by the consumer, or that are clearly personalised to the consumer's requirements (Art. 59 of the Codice del Consumo) – for example furniture and one-off pieces made to your measurements or specifications.
